Member's Information

What is Lease Enfranchisement?

This is the right for a leasehold flat or house owner, in England and Wales, to buy their freehold or to extend the leasehold term.

There are qualifying requirements for both the tenant and the building itself which include the length of ownership and the terms of the lease and as well as whether the property is used for business purposes, in which case it will not qualify.

If a lease were allowed to run through, the ownership of the property would revert to the leaseholder, or landlord. Extending or buying your lease will therefore be financially detrimental to him or her.

The calculations for working out what the lease is worth can be complicated as they include the current value of the unexpired lease term in ground rent, compensation to the landlord if losing the freehold on your property reduces the value of any other property owned, and can also include a monetary value for the fact that the leaseholders will be able to extend their own leases in perpetuity without paying further for the privilege.
