Before taking up a lease on a property you should normally have a Schedule of Condition undertaken by a Surveyor. This will document the condition of the property at a point in time. It is an important document as you will need to refer to it when the lease comes to an end. Dependent on the terms of the lease, it is possible that the tenant may have to pay for work to be carried out to ensure that the property is left in the same condition as it was when the lease started.
A landlord needs to ensure that a tenant looks after a property and keeps it in a good state of repair. As an aid to this process, a landlord may consider engaging a Surveyor to produce an interim Schedule of Dilapidation midterm of the lease or at an appropriate point in time before the end of the lease. This would give the tenant plenty of notice to carry out necessary maintenance rather than waiting until the end of the lease. At the end of the lease a full Schedule of Dilapidation can be undertaken to identify and cost any necessary work required to return the building to an acceptable condition. The tenant may undertake to have the necessary work carried out, or a financial payment may be agreed in lieu. These negotiations can be complex and getting help from a Surveyor with commercial experience may be cost effective.
